Embezzlement is theft from one's employer. Our law firm handles embezzlement cases frequently. If we can enter the case early enough, a very favorable agreement can often be negotiated with the employer. It is common to encounter cases where the money loss is secondary to hurt feelings, rejected romantic advances, or participation in criminal activity by the employer, such as tax evasion.
Penalties in embezzlement cases
State embezzlement cases are punished under the theft laws, which often add to the punishment by alleging breach of fiduciary duty, or a breach of trust. These cases often involve attorneys, accountants, trustees, executors, or others with no criminal past. No criminal cases involve more emotion, or are more susceptible to skillful negotiation than embezzlement cases. It sometimes can be worked out that these cases do not go to court.
The majority of our cases of this type not go to trial. The District Attorney's office is often willing to allow negotiated agreements that will restore some or all of the embezzled funds without criminal prosecution.
